(1.) Definitions

 bullet Customer(s):  Person, Group, or Clan who currently have service with DGServers LLC. Responsible for payment of service and up keep of that service.

 bullet Company:  DGServers LLC is a registered Limited Liability Company in the State of Ohio. All of this companies services are based out of state. Website and Game Service provide by DGServers LLC is licensed.

 bullet Game Server(s):  Game application hosted by DGServers LLC over the Internet. These are considered Shared Servers. Game(s) CD is purchased legally and rented out to Customer(s).

 bullet Dedicated Server:  Online 365 days a year. Allows full access to clients who rent them. Administrative settings allowed by Customer. Complete access via Remote Desktop or Remote Admin.

(2.) Responsibility Guidelines

 bullet Customer Responsibilities:  You are responsible for the upkeep of your service with us. Server configuration, Mods, Files, Patches are your responsibility. If your server is down, the person on the Billing Information is required to notify us as soon as possible via Support Ticket or Phone to make sure your game server is back online. Game Control Panel allows quick access to accomplish this goal. We do not monitor game servers on an individual basis, however our Techs do look at servers time to time. We want to help limit the amount of downtime you may experience. You must insure that your server follows our terms of service at all times.

 bullet Company Responsibilities:  We are responsible for the maintenance and uptime of our network and hardware. 365 days a year server technical support access. We are obligated to provide you with fast efficient support for your service with us. We require our staff to provide fast support to questions and concerns you may have on Shared Servers, Dedicated Servers, or any other service you rent from DGServers LLC.

 bullet Paying for Service:  All payments are due before service is rendered. A service month is 30 days; if you have paid for service for 3 months then you have 90 days of service. Service payments are expected on or before your next bill date. Billing due dates are (1st of every month). If you no longer require service we require you to cancel via support ticket and looking at your account management page. Requests to discontinue service must be entered no later then 7 days before your next payment date to avoid additional service charges. There are no refunds for unused service or on balances in our accounting system. Account credit balances can be used for current or new service at anytime.

 bullet Public/Private Servers:  If you ordered a password protected game server there are a few additional requirements you must follow. Your server may not be shared by more then 2 clans. You may not loan your server to any other clans, unless it's a clan you are having a match with. Your server password may not be advertised to the general public but may be posted in order to notify your clan members the proper password. We are not responsible for server take overs if this happens. Server passwords may not be posted in the server name. Our password protected game servers (Private Server) is designed for clan use only and is not intending to be used as a public game server. Server passwords must be changed every 45 days. Servers found without a password set will be charged as a public game hosting customer for the current billing month. Public servers can have no password set and may freely changed from password protected to public at your command.

 bullet Player Limits:  To provide everyone with a value dedicated game server there are limits on the number of players based on the service you applied for. Our system loads are partially based on the number of player slots that are allocated per box. If you adjust your player limit higher than your purchase. You can cause additional lag and performance issues for not only for your server.But others hosted on the same system. While we do not monitor our game server applications on a daily basis we do reserve the right to inspect any game server to insure they are not exceeding the current max player limit allowed for that account. Violations can result in immediate termination of service without refund. If your server is found with more players set then for the service you signed with your server will be charged for those additional players.

 bullet Files & Mods:  We reserve the right to remove alter or deny some files that cause performance related problems with your server or any other server that may be directly affected by such files. Restricted plug-ins currently include ping boosters or ping accelerators install on our game server systems. Custom Maps and other files may also be removed if found to alter or cause server problems.

 bullet Order Setup:  All orders are activated within 1 to 8 hours of payment confirmation. Most orders are set up within minutes. However we do not guarantee the time it takes for payment until activation. You may request a refund if your order is not activated within 24 hours of payment unless otherwise specified through us. We will not issue any refunds on new orders unless the activation has not occurred within 48 hours of payment.

 bullet Software Liability:  DGServers LLC is not responsible for limitations within some games, file modification, FTP access, or any other design control that is not allowed by some game server software. All issues with software design must be handled with the proper developers web site. Your responsibility to contact us about any important questions you have about your game server prior to purchase if you feel there are limitations that are important to you. Patches for games will be applied as soon as there released for general updates.

(3.) Dedicated Server

 bullet Dedicated Server Setup: Dedicated Servers setup is 12-24 hours. That setup time is not guaranteed in case we must purchase additional servers. You may request a refund on dedicated servers if your server is not activated within 3 business days or 72 working business hours.

 bullet Hardware Upgrade:  There will be a monthly charge on upgrades for hardware on Dedicated Servers. Ram, Graphics Cards, Processors are all priced and charged monthly as long as you rent. You do not buy the hardware, we are responsible for the purchase and upgrade of your machine once ordered by you the customer.

 bullet Canceling Service:  Dedicated Servers require a 30 day notice to cancel. Cancellations must be handled directly over the phone to a Sales Tech.. If an account is canceled before the 30 day notice a $100.00 early termination fee applies.

 bullet Software Liability:  Dedicated servers are selfed managed. We include some basic software services but do not provide any guarantee over software other then the operating system that is first installed. You are responsible to keep your server up to date with service patches. In the event a system becomes unusable, there is a $50.00 charge to reinstall Operating System if it's found you caused an error by not updating. Windows 2003 is standard on all servers. Windows 2008 is being integrated slowly into some of these machines. Patches and Updates are issued by Microsoft and we are required to keep those updated. Failure to do so can cause lag, security, and unsafe file sharing problems.

 bulletRefund Policy:  Your are eligible for a refund if we do not maintain 90% network uptime over the course of a 30 day billing cycle. Hardware failure requires a 24 hour repair time. If we can not supply new hardware in case of faulty hardware failure. We will issue a refund after the 24 hours has past. We reserve the right to extend the 24 hour hardware replacement.

(4.) Level Agreement and Refund Policies0

 bullet Refund Policy:  You are eligible for a refund if we do not maintain 90% uptime based on a 30 day period. Service that is not restored within 24 hours of the time it went down, will have a prorated refund for the service that month. We ask for 24 hours to allow us to get hardware installed in case of a failure.

 bullet Service Credits:  We will credit your account if your server is down for a period of time of more then 24 hours in any given day due to hardware or network issues. Credits will be determined by our staff at the time of the issue and will be credited directly to your online account once the issue is resolved. Service credits may not be paid in cash, or refunded to credit cards.

5.Payments for Service

 bullet Payment Process:  All payment collection is done by DGServers LLC. Paying with Paypal or Money Order, please make it out to DGServers LLC. Paypal users will see DGServers LLC on there statement. Contact DGServers LLC if you have questions about your bill.

 bullet Payment Forms:  We accept payment via Paypal and Money Order(s). We also accept Credit Card via Paypal or Personal Checks. Personal Checks will take 10 additional business days to clear.

 bullet Canceling Service:  You may cancel your service at anytime. In order to cancel service we require you to cancel via support ticket no later then 1 week before your next billing period. Upon canceling your service will continue until your current billing period ends. Any uncollected balances must be paid when you cancel. All funds paid to DGServers LLC are non-refundable and can only be used toward service. You have 72 hours upon sign up for new service to cancel and receive a refund prorated for those 3 days. Past 72 hours you must continue service with us through the 30 days and service will be canceled at the end of those 30 days. No refunds will be issued unless otherwise noted in agreement with the customer.

 bullet PayPal Subscription:  When paying for service via PayPal Option you have a choice of subscription or clicking for one time PayPal Payment.

6.Additional Terms

 bullet Pricing Subject to Change:  Prices are subject to change with little or no notice at anytime. If you are a customer before a price decrease, you are not eligible for a lower price. In order to obtain a lower price you must cancel your current service and be subject to a setup fee of $20.00 to obtain the new price.

 bullet Default Files:  Game Servers are setup with the base install according to the game type ordered. The price you pay when signing for service will remain in effect until you cancel. We will not increase your service bill from the time you purchase to the time you cancel your service.

 bullet Support Admin:  In order to better service the customer, we ask that the main person on the Billing Account assign 2 people to be allowed access to support for there service. In order to do this, the person on the Billing Account must contact Support and assign someone to be allowed help. Anyone not assigned to the account will be denied access.

 bullet Failure to Comply:  Failure to comply with all current and future Terms of Service Agreements can result in termination of your account. We reserve the right to discontinue your service is found in violation of our Terms of Service. Failure to comply with our Terms of Service on Files, Shared Server Control Panel, or Web Hosting guidelines can result in termination with no notice and a refusal of refund for that service. We reserve the right to terminate with non compliant customers.
